These Terms of Service (“Terms”) govern your access to and use of the websites, online stores, applications, and related services (together, the “Platform”) provided by Benja Group GmbH.

2) Definitions

- “Products” means physical products sold through the Platform.

6.1 Pricing and availability

All prices shown on the Platform are listed in USD & Pound unless stated otherwise and may change at any time. Product availability may be limited or discontinued.

We strive to display accurate product and pricing information, but errors may occur. If we discover an error affecting your order, we may:
(a) contact you to confirm the corrected information, or
(b) cancel the order and issue a refund if payment has already been collected.

6.2 Taxes, duties, and fees

Taxes, duties, and shipping fees (if applicable) will be shown at checkout unless otherwise stated. International shipments may be subject to customs fees or import duties which are your responsibility unless we explicitly state otherwise.

6.3 Payment

You agree to pay all charges associated with your order using the payment method selected at checkout. We may refuse or cancel orders if payment is not authorized, suspected fraud exists, or we cannot verify required information.

Estimated delivery times are provided for convenience and are not guaranteed. Risk of loss and title transfer rules may vary by jurisdiction and shipping terms; where mandatory consumer laws apply, your statutory rights remain unaffected.

8) Returns, Refunds, and EU Right of Withdrawal

8.1 EU/EEA/UK consumers – right of withdrawal (distance sales)

If you are a Consumer in the European Union/EEA (and where applicable the UK), you generally have the right to withdraw from certain distance purchase contracts within 14 days of receiving the goods, without giving any reason, subject to legal exceptions (for example, certain sealed goods, customized items, or digital content once performance begins with your prior consent).

To exercise your right of withdrawal, contact us at info@limu.tech with a clear statement of your decision. We will process eligible refunds in line with applicable law after receiving the returned goods or proof of return, as applicable.

This statutory right of withdrawal applies independently of any additional commercial return policy we offer.

8.2 Legal warranty (EU consumers)

If you are a Consumer in the EU, statutory warranty rights apply (including a minimum two-year legal guarantee for goods, where applicable). Nothing in these Terms limits those mandatory rights.

9) Subscriptions and Digital Services (If Applicable)

If we offer subscriptions or paid Digital Services:

- Billing terms (monthly/annual), pricing, and renewal rules will be shown at checkout or in your account.  
- Subscriptions may renew automatically unless canceled before the renewal date.  
- Where required by law, refunds may be available; otherwise, fees are generally non-refundable once the billing period begins, unless stated in our policies or required by mandatory law.  

If you purchase via a third-party marketplace (e.g., Apple App Store, Google Play), that marketplace’s billing and cancellation rules may apply.

10) Acceptable Use

You agree not to:

- Use the Platform unlawfully or in a way that infringes others’ rights.  
- Attempt to gain unauthorized access to accounts, systems, or networks.  
- Interfere with or disrupt the Platform (e.g., malware, scraping, denial-of-service).

We may investigate suspected violations and may suspend or terminate access as described below.

11) Intellectual Property

The Platform and all associated content, designs, software, trademarks, and logos are owned by Benja Group GmbH or its licensors and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, lease, or create derivative works from the Platform or its content except as expressly permitted by law or with our prior written consent.

12) User Content (If Applicable)

If you submit content to the Platform (e.g., reviews, comments, support requests), you grant us a non-exclusive, worldwide, royalty-free license to use that content for operating, improving, and marketing the Platform, subject to applicable law and our Privacy Policy. You represent that you have the right to submit such content.

13) Third-Party Links and Services

The Platform may contain links to third-party websites or services. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.

15) Termination

We may suspend or terminate your access to the Platform if we reasonably believe you have violated these Terms, used the Platform unlawfully, or pose a security risk. Where feasible and appropriate, we will provide notice. You may stop using the Platform at any time.

16) Disclaimers

To the maximum extent permitted by law, the Platform is provided “AS IS” and “AS AVAILABLE.” We do not guarantee that the Platform will be uninterrupted, error-free, or secure.

This section does not affect mandatory rights you may have under consumer protection laws.

17) Limitation of Liability

To the maximum extent permitted by law:

- We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the Platform.  
- Our total liability for any claim relating to the Platform will not exceed the amount you paid us for the relevant order/product/service giving rise to the claim, except where mandatory law requires otherwise.  

Nothing in these Terms excludes or limits liability for:
(a) intent or gross negligence,
(b) death or personal injury caused by negligence,
(c) fraud or fraudulent misrepresentation,
(d) any liability that cannot be excluded or limited under applicable law (including mandatory consumer rights).

18) Indemnification (Business Users)

If you use the Platform on behalf of a business, you agree to indemnify and hold harmless Benja Group GmbH from claims arising out of your unlawful use of the Platform or your violation of these Terms, to the extent permitted by law.

19) Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG), to the extent permitted.

If you are a Consumer, you also benefit from mandatory consumer protection provisions of the country where you reside; nothing in these Terms deprives you of those protections.

20) Dispute Resolution / Venue

If you are a Consumer, you may bring claims in the courts of your place of residence where allowed by law.

If you are acting as a business, the exclusive place of jurisdiction shall be Hamburg, Germany, to the extent permitted by law.

21) Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
